Read the two rulings by U.S. Supreme Court in 1831 and 1832
On March 18th, 1831, the U.S. Supreme Court ruled in the case of Cherokee Nation v. Georgia:
Majority Opinion Written by Chief Justice John Marshall (read following)
“The court has bestowed its best attention on this question, and, after mature deliberation, the majority is of the opinion that an Indian tribe or nation within the United States is not a foreign state in the sense of the constitution, and cannot maintain an action in the courts of the United States….the relationship of the tribes to the United States resembles that of a ‘ward to its guardian’.”
On March 23rd, 1832, the U.S. Supreme Court ruled in the case of Worcester v. Georgia:

“Treaties and laws of the United States contemplate the Indian Territory as completely separated from that of the states; and provide that all intercourse with them shall be carried on exclusively by the government of the union. The Cherokee nation, then, is a distinct community occupying its own territory in which the laws of Georgia can have no force. The whole intercourse between the United States and this nation, is, by our constitution and laws, vested in the government of the United States.”
Specific Essay Instructions (Grade Will Reflect):

– Read the two rulings by U.S. Supreme Court (above) in 1831 and 1832
– Write an essay that includes the following:
– Did the Supreme Court make correct ruling regarding the lands occupied by Cherokee?
– Was President Andrew Jackson’s decision to ignore the Supreme Court ruling illegal?
– How did this disagreement between Supreme Court and Jackson lead to Trail of Tears?
– In your opinion (subjective view), what should have been the outcome?
– Use “I think”, “I believe” or “in my opinion”
– Use of provided Lecture Notes is encouraged
– Essay must be three to four pages in length, with percentage of completion effecting overall grade
– For example, with only two full pages written, 33.33% is missing from 100% assignment
– In this instance, the overall grade will not be higher than a 67
– Multiple paragraphs, with minimum of three sentences in each
– College level work is expected and it must be individually completed only
– College format for your essay must include the following:
– Minimum three full pages of written essay (not counting name and title on first page)
– No bigger than double spacing throughout, including between the paragraphs (no extra spacing)
– No bibliography or works cited is necessary and if included, is not a part of the three pages minimum written portion
– Black font color, calibri, aerial or times new roman font type, no bigger than 12 point font
– Portrait format, 1-inch margins on all sides, left or even justified (not right or centered)
– College level writing, grammar, capitalization, etc. is expected
– Must answer all questions in essay document assignment, include opinions and plagiarism must not be over 25%
– Upload ESSAY as Word or PDF, into Canvas Assignment before due date (11:59pm)
– Emails are not accepted and Essays must be converted into Word or PDF format
– Essays with plagiarism greater than 25% will result in a ZERO
– Students may make multiple submissions to get plagiarism under 25% or less
– Best way to avoid plagiarism is to write in “your own words” and give original opinions
– The Essay document is uploaded in Canvas, under Modules
– Late work is not allowed for Essays

Write at least three full pages, including top of page four, with at least three lines. No Works Cited or Bibliography is needed.
